Gift Card Terms and Conditions

About these terms

1.1 These terms apply to all Take Two Art gift cards. Gift cards are issued by FATT Pty Ltd (ACN 665 288 899) as trustee for the Truscott Family Trust, trading as Take Two Art (ABN 72 449 921 415) ("Take Two Art", "we", "us").

1.2 "Purchaser" means the person who buys a gift card. "Recipient" means the person who receives and uses it. "You" means either, as the context requires.

1.3 By buying or using a gift card, you agree to these terms. Our Website Terms and Conditions, Course Terms and Conditions and Privacy Policy also apply.

1.4 If these gift card terms conflict with any of those documents, these gift card terms apply to the extent of the conflict.

Buying a gift card

2.1 Gift cards are digital only. We email the gift card and its code to the recipient, and a receipt to the purchaser.

2.2 You can choose one of our set amounts or enter a custom amount, from a minimum of 50 up to a maximum of 1,000 in the currency of purchase.

2.3 You can buy a gift card in AUD, NZD, GBP, EUR, USD or CAD. A gift card can only be spent in the currency it was bought in, and can't be switched to another currency later. When buying for someone overseas, choose the currency your recipient will shop in. If their currency isn't listed, choose USD.

2.4 Please check the recipient's email address carefully. We aren't responsible for a gift card sent to an incorrect address entered by the purchaser, but we will help where we can (see section 6).

Using your gift card

3.1 A gift card can be used to buy any digital product on taketwoart.com, including Signature courses, On-Demand courses, Studio Sessions, Masterclasses and course bundles. Gift cards can currently only be used on orders paid in full, not toward payment plans or instalments.

3.2 A gift card can't be used for live in-person events, physical products, or to buy another gift card.

3.3 To redeem a gift card, enter its code at the Take Two Art checkout on our website. Gift cards can't be redeemed by phone, email or through any other platform.

3.4 Gift cards can be used on sale-priced products. They can also be used together with discount codes, unless the terms of a particular discount code say otherwise.

3.5 You can use more than one gift card on a single order, provided all the cards are in the same currency as the order.

3.6 If your order costs more than your gift card balance, you can pay the difference by another accepted payment method.

3.7 A gift card holds a value, not a place in a course. Course prices, availability and enrolment dates may change, and Signature courses may have limited places or fixed enrolment periods.

Balances and expiry

4.1 Take Two Art gift cards have no expiry date. Your gift card remains valid until its full balance has been spent.

4.2 You don't have to spend the full balance in one order. Any remaining balance stays on your gift card for future purchases.

4.3 After each purchase, we email you a receipt showing your remaining balance. You can also ask for your balance at any time by emailing support@taketwoart.com.

4.4 We don't charge any fees on gift cards, including activation, account-keeping or inactivity fees.

Refunds and cash

5.1 Gift cards are non-refundable, except as set out in 5.2 or where the law requires otherwise.

5.2 If you live in the European Union or the United Kingdom, you can cancel your gift card purchase within 14 days for a full refund, provided no part of the gift card has been used. To request a refund, email support@taketwoart.com with your order details. Refunds are paid to the original payment method.

5.3 Gift cards can't be exchanged for cash, except where the law requires it (for example, cash redemption of small remaining balances in some US states).

5.4 If a course paid for with a gift card is later refunded under our Course Terms and Conditions, the amount paid by gift card is returned to the gift card balance, not paid in cash. Any part of the order paid by another method is refunded to that method.

5.5 Nothing in these terms excludes, restricts or modifies any rights you have under the Australian Consumer Law or the consumer laws of the country where you live.

Keeping your gift card safe

6.1 Gift cards are transferable. Anyone who has the code can use the balance, so please store your gift card code securely and treat it like cash.

6.2 If your gift card is lost or stolen, email support@taketwoart.com as soon as possible. If we can verify the original purchase, we will cancel the original code and issue a replacement with the remaining balance at the time we cancel it.

6.3 We can't replace any balance spent before you told us the gift card was lost or stolen.

Promotional gift cards

7.1 We may give away gift cards or credit free of charge, for example as competition prizes, referral or ambassador rewards, or customer service gestures ("promotional gift cards").

7.2 Promotional gift cards are not sold, so different conditions may apply. These may include an expiry date, a restriction on which courses they can be used for, or a rule that they can't be transferred.

7.3 Any expiry date or special condition will be stated clearly on the promotional gift card or in the email that delivers it. Where no conditions are stated, these terms apply in full.

7.4 Promotional gift cards have no cash value and can't be refunded or exchanged for cash, except where the law requires it.

Fraud and misuse

8.1 We may cancel or suspend a gift card, or refuse to accept it, if we reasonably believe it was bought or obtained by fraud, with a stolen or unauthorised payment method, or in breach of these terms.

8.2 Gift cards may not be resold, offered for sale on third-party sites, or used for any unlawful purpose. We may cancel gift cards that are.

8.3 Where we cancel a gift card that a recipient received in good faith, we will contact them and act fairly, in line with our obligations under the law.

9. Emails, privacy and marketing

9.1 To deliver a gift card, we collect the purchaser's details and the recipient's name and email address. We handle this information in line with our Privacy Policy.

9.2 We will send the recipient service emails about their gift card. These include the gift card itself, balance receipts after each purchase, and periodic reminders while a balance remains unused. The recipient can opt out of reminder emails at any time.

9.3 Receiving a gift card does not sign the recipient up to our marketing emails. We only send marketing emails to purchasers or recipients who have separately opted in, and you can unsubscribe at any time.

9.4 The purchaser confirms they have the recipient's permission, or a reasonable basis, to share the recipient's name and email address with us for delivering the gift card.

General

10.1 We may update these terms from time to time. Changes won't reduce the value of, shorten the validity of, or add fees to any gift card already sold. The terms in force when a gift card was bought continue to apply to it, unless a later change is more favourable to you.

10.2 If Take Two Art is sold or restructured, we will take reasonable steps to ensure existing gift cards continue to be honoured.

10.3 These terms are governed by the laws of Victoria, Australia. This doesn't remove any protections you have under the consumer laws of the country or state where you live.

10.4 If any part of these terms is found to be invalid or unenforceable, the rest of these terms continue to apply.
